A eutanásia no direito brasileiro: uma análise da legislação mediante a sua prática.

Abstract

The practice of euthanasia is a controversial subject that involves social, moral, ethical, religious and legal issues. The present work aims to analyze the practice of euthanasia in Brazilian legislation. Euthanasia is the act of causing the death of a person with the purpose of alleviating the pain and suffering caused by an incurable disease and that, generally, the request, become from the victim itself, for no longer hold that degrading life to which found. It begins by presenting the general aspects of euthanasia, including the origin and historical evolution, concepts, typifications and their modalities such as ortothanasia, dysthanasia, misthanasia and assisted suicide. It follows with discussion in the fields of bioethics and bio-law, exposing the guiding principles. It ends with a debate about euthanasia in Brazilian law. It is a qualitative research, as to the approach of the problem; it is classified, as to the goals, as exploratory and descriptive; the technical procedures as bibliographical and documentary; and still as nature, is characterized as basic. The result of the study demonstrates that legal regulation is necessary in Brazil and that be appropriate in relation to euthanasia, so that it can resolve doubts and give legal security to those who may have the will to practice it.
