Cidadania e dignidade aos migrantes: uma análise da nova Lei de Migração ( Lei 13.445/2017).

Abstract

The current migratory crisis is a constant theme of discussions on the national and international scene. The matter has become an object of concern, as the migratory flows, each day multiply accompanied by a growing violation of Human Rights. Migration is part of human history. Not only a geopolitical, economic and social problem, migration is a human right that goes beyond borders, concepts and ideologies. Finding solutions in international law and in internal normative instruments is a necessity. Brazil is a large recipient of migrants from the world and, together with the UN, acts as a regional leader in affirmative policies to minimize the problems faced by migrants, whether refugees, migrants, stateless persons or migrants. Filling in a legal loophole in national legislation to have a law on migration at the time of the Federal Constitution of 1988, Brazilian Immigration Law No. 13,445 wassanctioned on May 24, 2017, and represents democracy and the defense of human rights in Brazilian law, for all, without distinction. The monographic work has as its theme: "Citizenship and dignity of migrants: an analysis of the new Migration Law (LEI 13445/2017)". The problem that the research seeks to analyze is whether the law 13445/2017 is really beneficial to the migrants in the Brazilian State. The research works with the hypothesis that, despite limits and challenges, the law is an advance and achievement for human rights. The objective of the research is to analyze the main aspects of Law 1345/13 and present the innovations in the national legal order. For this purpose, as methodological aspects, the deductive method is used, the methods of historical and interpretative procedure, using bibliographical and documentary revisions, laws, books, internet and articles of periodicals, with content analysis as research technique to construct the theoretical reference. The new legal instrument seeks to protect migrants in their various faces and characteristics, and gives everyone, including the Brazilian emigrant, the necessary legal protection. Citizenship, participation and legality are pillars of the new legal apparatus that defends above all the equality of human beings and the dignity of the human person, wherever he is.
