Abstract

Double parenting is another important tool for the realization of the rights and duties of the social-affective relationship, because it is with parental duplicity that a child can acquire more than one father and / or mother, being one of these affective relationships. Thus, it is necessary to conduct a study on these relationships arising from affect without neglecting the biological relationship and the effects it entails. This paper aims to clarify the recurrent rights and duties of this phenomenon, involving not only the right to name, but also the right to custody, maintenance and inheritance, in view of the insertion of a new affective paternal name in the Civil Registry. It also analyzes the viability of this new name in the birth certificate, the conditions for affection to become a paternity bond, and the equity that must exist between the biological and the social-affective father, always considering the best for the smallest and the smallest. your will. Searching the answer to the problem of this work, it was methodologically operated with a deductive approach and the historical and comparative procedure methods, besides the bibliographic and documentary research techniques. The research results indicate the viability of parental duplicity in the birth certificate; the legal effects born through this phenomenon, not only for the socio-affective father but for the whole affective family that was acquired through the process.
