Análise da aplicação do princípio da insignificância pela autoridade policial.

Abstract

The present monographic work aims to address the theme of the Trifle Principle enforcement by the police authority, a subject that is of great relevance to current and future law, as it aims to decrease the demand for trifle crimes that reaches the judicial sphere, entailing slowness and a higher incidence of state punitive prosecution for crimes that protect the most important legal assets. The Precint Chief is considered a Law Operator in many States of the Federation, and is also the great filter that separates and elucidates the most diverse types of cases, having a discretionary power to make decisions related to his role, with the goal to exercise it in the best way. Thus, this work seeks to find out if the enforcement of the insignificance principle by the police authority characterizes the usurpation of functions of other law operators members or if it benefits them. To do so, it will be used the deductive method as methodology for the creation of this research, which seeks the specialties within the subject, also utilizing the exploratory bibliographic research, through scientific articles, doctrine, legislation and jurisprudence of higher courts.
