dc.description.resumoA união estável foi alçada a entidade familiar pela Constituição Federal de 1988, e como entidade familiar que e, apresenta reflexos diversos, próprios de uma família. Apos a Constituição Federal de 1988, visando regular os efeitos jurídicos decorrentes da nova entidade familiar, surgiram a lei n° 8.971/94 e a lei n° 9.278/96, especificas a este fim, vindo a ser tratada posteriormente, no Código Civil de 2002. O presente estudo objetiva analisar o instituto da união estável, mormente no que tange aos seus elementos caracterizadores, seus reflexos de ordem patrimonial e o contrato de convivência. Mais especificamente que elementos caracterizam realmente a união estável; como se desenvolvem os reflexos patrimoniais da união estável, inclusive seus reflexos no direito intertemporal; e as características e possibilidades do contrato de convivência. Para tanto, utilizou-se de pesquisa bibliográfica, doutrinaria, jurisprudencial e da legislação positiva. Dessa forma, pretendera aprofundar-se no tema, a fim de se obter respostas as indagações próprias de tema tão complicado e delicado no ordenamento jurídico. Espera-se com este estudo um maior esclarecimento de tema pouco estudado, proporcionando um melhor uso de instrumentos, aplicáveis a união estável, e direitos decorrentes de tal relação, propiciando uma melhoria na vida dos companheiros.pt_BR

dc.description.abstractThe stable union was raised the family entity by the federal constitution of 1988, and as family entity that is it present several reflexes, own of a family, after the federal constitution f 1988, seeking to regulate the current juridical effects of the new family entity, they appeared the law n° 8.971/94 and the law n° 9.278/96. specific to this end coming to be treated later. In the civil code off 2002. the present study aims at to analyze the institute of the stable union, especially with respect to their elements characterized their reflexes of patrimonial order and the coexistence contract more specifically than elements really characterize the stable union as he she grows the patrimonial reflexes of the stable union, besides their reflexes in the right intertime; and the characteristic and possibilities of the coexistence contract, for so much, it was used of bibliographical research, doctrinarian, Jurisprudential and of the positive legislation .in that way it will intend to deepen in the theme in order to it to obtain answers the own inquiries of such complicated and delicate theme in our juridical ordainment. It is waited with this study a larger theme explanation little studied, providing a better use of instruments applicable the stable union, and current rights of such relationship, propitiating an improvement in the companions'life.pt_BR
