Abstract

Multi-parenting is a modality of family constitution based on affectivity that has triggered several legal effects in Succession Law and other fields of Law. This research aims to examine the form of division of inheritance in multi-parental families. It begins by presenting a conceptual analysis and historical evolution on the concept of family, addressing the guiding principles, as well as describing the modalities of family constitution and the legal effects arising from family relationships. It is followed by a presentation of general aspects about Succession Law in Brazilian legal system. Regarding approach method, the deductive one was adopted, as for the type of procedure, the technical bibliographic one was chosen. It was hypothesized, in the sense that the study demonstrates, that it is necessary to think of a new succession division for multi-parental families, thus promoting a division into three parental lines so as to reduce inequalities arising from new family compositions and the effective application of the principle of legal equality.
