Tribunal do júri: questões controvertidas.

Abstract

This work monographic has as purpose, to show the several arguments that they are positioned in favor, and against the Institution of the Popular Jury's Tribunal, taking the reader the if it puts in the hermeneutic position, in a reflection on the efficiency of the institution, and the risks that exist in transferring the competence of the judgement of the deceitful crimes against the life for the judges, moving away the popular participation of the administration of the justice, dialectics that I denominated: controverted subjects. He/she deserves prominence also, the focus that was given to the constitutional beginnings of the sovereignty of the verdicts, defense width and the secrecy of the votings, so fundamental the structure and the impartiality of the Popular Tribunal. Another interesting point, relatively a little mentioned in the works of conclusion of the right course, related to this theme, it is the Jury's Tribunal in the Compared Right, extraordinary allusion researched essentially in the theory of the teacher's doctorate and right judge Guilherme Nucci, approved with note ten in PUCSP. Being sincere, in spite of fundamental, constituting the technical right call, I didn't look for to be prolonged in the procedural aspects of the Jury's Tribunal, tends in view that all the manuals of penal procedural right bring usually the subject, being mainly objective of the public contests.
