Abstract

The fulfilment of the privative penalty of freedom always excites many questionings, the present Work of Conclusion of Course carries through a case study analyzing the application of the penalty in Agricultural the Criminal Colony of the Hinterland, verifying itself the used ways in the execution i f basing on the fulfilment right prescribed them to the convict for the Brazilian legislation. The analysis focuses the physical conditions of the prisional unit, the classification of the imposed a fine on one, the granted assistance and the availability of human resources, in the intention to identify the imperfections in the system of application of the penalty. The general objective of this work is to analyze the material conditions of fulfilment of the privative penalty of freedom in the prisional establishment chosen team, being aimed at to investigate the possibilities of reintegration of imposed a fine on and its consequent reintegration to the society. The specific objectives are, respectively, to identify to the convergent points between the legal forecast of the rights and duties of the prisoner and its practical verification in the daily one of Agricultural the Criminal Colony of the Hinterland, to trace the profile of the imposed a fine on one of this prisional establishment, focusing, also, the expectation of reintegration to the social environment. For in such a way, they will be used: the interpretative-legal method, through fitments to develop the bibliographical research and the empirical method by means of visits that had been carried through to the prison establishment in order observations in locu, elaboration of questionnaires - destined to Director-Aid and imposed a fine on, and colloquies with employees. One searchs to reach the presented objectives, to the light of the following problem: it would be imposed a fine on of Agricultural the Criminal Colony of the Hinterland fulfilling adequately the penalty that were imposed to it, being, therefore, capable of reintegrating? The hypothesis is negative, before the prisional reality of Brazil. One concludes, however, that the current conditions of Agricultural the Criminal Colony of the Hinterland are relatively good, however, it is still lacking very much so that the legal least necessary requisites are attended to the reintegration of a prisoner, needing a reorganization to be able to guarantee the dignity human being of imposed a fine on in way the uniform.
