| ???metadata.dc.description.resumo???: | Este trabalho possui como foco central a analise da Lei n° 11.441/07 que trouxe inovações no campo das formas de dissolução do casamento. Dessa forma e elaborado através dos métodos histórico-evolutivo, cientifico de pesquisa bibliográfica e de campo, alem do método exegético - jurídico. A partir dessa lei a dissolução marital pode se da administrativamente no cartório de registro civil, desde que os cônjuges cheguem a um consenso e não possuam filhos menores. O novo método ajuda na celeridade dos processos de dissolução e desafoga um pouco o judiciário, contudo ainda e pouco discutido nas doutrinas, deixando assim pairar algumas duvidas ao seu respeito. A pesquisa pretende responder algumas dessas indagações, dividindo-se em três capítulos, nos quais abordam inicialmente o instituto do casamento e suas peculiaridades. O segundo e terceiro capítulos são destinados as formas de dissolução do casamento, onde o ultimo, em especial, conta com a abordagem da Lei n° 11.441/07. |
| Abstract: | This work has as central focus the analysis of Law N°. 11.441/07 that brought innovations in the field of forms of dissolution of marriage. Thus is produced by the methods-evolutionary history, scientific research bibliographic and field, in addition to the method analitic law. Since that law to marriage dissolution can give administratively in notary's office of civilian registration, provided that the spouses come to a consensus and do not have children. The new method helps in the speed of the processes of dissolution and desafoga somewhat the judiciary, but is still little discussed in doctrines, thus leaving some questions loom to them. The research aims to answer some of those questions, dividing itself into three chapters, in which initially address the institute of marriage and its peculiarities. The second and third chapters are intended ways of dissolution of marriage, where last, in staff, account with the approach of Law N°. 11.441/07. |
