Os reflexos da lei de investigação criminal na atuação do Delegado de Policia.

Abstract

This paper discusses the effects of the Criminal Investigation Law on the Police Delegate's performance and its repercussions on the criminal investigation, especially regarding the guarantees given to him, as well as on the demonstration of the importance of the Delegate on criminal investigation in Brazil. The purpose of this scientific research is to understand how the criminal investigation conducted by the Judiciary Police in the Brazilian legal system, identify relevant aspects of the law 12.830 / 13, and justify the role of the Delegate in the criminal investigation. For the study, the method of approach was the deductive, which uses indirect documentation from the collection of doctrinal, legislative and jurisprudential data. To achieve the proposed objective, it will first address points regarding Criminal Prosecution, Criminal Procedure Systems, Administrative Police, Judicial Police and Investigative Police, Police Investigation and other criminal investigation procedures conducted by the Police Chief, then clarify necessary points on Law 12.830 / 13, with respect to guarantees given to the delegate and provisions regarding the conduct of the Police Inquiry and finally to demonstrate the reflexes of the law criminal investigation in the performance of the Police Delegate, which although not being the exclusive authority for such prerogative, is the most capable therefore.
