| ???metadata.dc.description.resumo???: | O tema do presente trabalho trata sobre a fiscalização e a devida aplicabilidade da pensão alimentícia em favor do menor. Como objetivo desse estudo, procurou-se identificar os problemas relativos a fiscalização e a devida aplicabilidade da pensão alimentícia dos filhos menores. Para tanto, pesquisou-se acerca do instituto da pensão alimentícia, bem como, do exercício do poder familiar e dos direitos aos alimentos, tanto no diploma civil como no Estatuto da Criança e do Adolescente. O trabalho foi estruturado em três capítulos: no capítulo inicial, analisou-se especificamente o exercício do Poder Familiar. Posteriormente, no segundo capítulo, analisou-se o direito aos alimentos. Por fim, no terceiro e ultimo capítulo, tratou-se do assunto específico do presente trabalho, isto e, da obrigação alimentar, expondo os posicionamentos doutrinários, jurisprudenciais e um estudo dos conflitos familiares decorrentes do pagamento da pensão alimentícia para os filhos menores, e que se pode verificar que alguns menores não usufruem no todo, ou em parte do valor atribuído pelo provedor. |
| Abstract: | The theme of this paper deals with the applicability and proper enforcement of child support in favor of the minor. Aim of this study, we sought to identify problems relating to enforcement and applicability of the due alimony of minor children. For this, researchers are on the Institute of alimony, as well as the exercise of family power and rights to food, both in civil law as the Statute of Children and Adolescents. The work was divided into three chapters: the first chapter, we analyzed specifically the exercise of family power. Later in the second chapter, we analyzed the right to food. Finally, the third and final chapter, it was the specific subject of this work, that is, the maintenance, exposing the doctrinal positions, a study of jurisprudence and family conflicts resulting from the payment of child support for minor children, is one might find that some children do not enjoy in whole or in part on the value assigned by the provider. |
