Abstract

This scientific research aims to show the evolution of the Legal Rights of Workers, presenting the history of the relationship Worker - Policyholder Services, from the emergence of the Labour Law Material passing through the achievements of workers rights throughout the centuries until today. It is noteworthy, however, the recent struggle of the working student for the right to special working hours to attend classes and evaluations, when these can not be taught in a time different from their normal working day, making use of right compared to Brazilian Portuguese law, in which the student worker already has its own legislation, which are regulated all their rights. It should be noted also, the excessive delay of the much longed for labor reform, which should be enacted so as to close loopholes in the Consolidation of Labor Laws, besides regulating the rights guaranteed in the Constitution of 1988 that still require additional infra Law . To this end, it was necessary to gather and analyze doctrine, legislation, jurisprudence and possible papers already published on the subject, using three methods of scientific research: the hypothetico-inductive method as approaches and methods-historical exegetical and comparative-legal, as methods of procedure.
