| ???metadata.dc.description.resumo???: | Este trabalho objetiva promover a discussão acerca da dissolução das uniões entre pessoas do mesmo sexo (homo afetivas) sob o viés dos efeitos obrigacionais dai decorrentes. Ademais, analisa-se a evolução dos conceitos de família, exatamente quando se defende que com o progresso constante dos valores sociais e a realidade atual da comunidade familiar, quando se propicia que abarque em sua base novas formas de constituição das entidades familiares. As pessoas homossexuais tem, portanto, sob o prisma de proteção a dignidade da pessoa humana e da igualdade constitucional, os mesmos direitos e os mesmos deveres ante a sociedade, possibilitando-se assim que sejam relegados efeitos jurídicos semelhantes as uniões entre homem e mulher. Dessa forma, não se descura da contribuição do Poder Judiciário, com o manejo dos preceitos constitucionais, para salvaguardar os direitos das minorias, em particular quando se reconhece um novo paradigma em face do instituto da Família (constitucionalmente assegurado) visto sob o aspecto afetivo. |
| Abstract: | This work aims to promote discussion about the dissolution of unions between persons of the same sex (homoafetivas) under the bias of the effects heritage resulting. Moreover, there analyzes the evolution of the concepts of family, exactly when it argues that with the constant progress of social values and the current reality of the family, when it provides that embraces its base in new ways of formation of the entities relatives. People homosexuals have therefore the prism of protecting human dignity and equality constitutional, the same rights and duties before the same society, thereby enabling it to be relegated legal effects similar to unions between men and women. Thus, it is not overlooks the contribution of the Judiciary, with the management of constitutional precepts, to safeguard the rights of minorities, particularly when it recognizes a new paradigm in the face of the Institute of the Family (constitutionally guaranteed) seen from the aspect affective. |
