???metadata.dc.description.resumo???:	Este trabalho fora motivado a partir da escassez do estudo acerca do sistema carcerário aplicado no Brasil, na Paraíba e no mundo, bem como pela falta de uma maior analise sobre o problema, dentro das instituições de ensino superiores do Brasil. Fora utilizado, o método indutivo como forma de abordagem e quanto ao procedimento, foram utilizados os métodos, histórico, estático e de estudo de caso. O trabalho ora tratado, traz um histórico do sistema carcerário brasileiro, o direito/dever de punir do estado, trazendo informações quanto os primeiros passos, desde o Brasil Império ate os dias de hoje, bem como a "evolução" de suas penas e a sua forma de execução pelo Estado. Descreve a situação difícil e precária em que hoje se encontra o sistema presidiário, bem como os principais problemas (como a ineficácia da ressocialização do apenado, a interrupção da sua pratica delitiva como por exemplo, o uso do celular dentro das cadeias) que afloram no seio da sociedade. Trata também das possíveis soluções para essa problemática, como a privatização do sistema, um maior e melhor uso e aproveitamento das penas restritivas de direito, uma melhor aplicação e estruturação do trabalho dos apenados como forma de ressocialização e dignificação do detento. Relata números de censos presidiários, com a opinião publica a respeito da situação enfrentada, como também, uma pesquisa de campo realizada nas cidades de Patos e Sousa, ambas no estado da Paraíba, sobre o sistema carcerário e suas soluções. Portanto, busca-se uma melhor divulgação para a comunidade acadêmica, com especial direção para os da área de ciências humanas, com especificidade os da ciência da direito, bem como ao publico em geral, sobre o problema enfrentado e suportado pelas sociedades contemporâneas e passadas, desde que o mesmo fora implantado no nosso Pais.
Abstract:	This work had been motivated to leave the shortage of the study about the system of the prison applied in Brasil, in Paraiba and in the world, as weel as for the back of a bigger analysis in the problem, inside the institutions of superior education of Brasil. It had been used, the inductive method as the formo f the approach and as for the procedure, they were them used methods, historical, the static ando of study of case. The work but treatise, bring of the system historical of the brasilian prison, the right/duty of the punish of the state, bringing to the information how many the first steps, of Brasil empire yntil the days today, as weel as the "evolution" of its eathers and form the execution of the state. Describe the difficult of the situation precarious if encounter the prisoner system, well as of the system like the main problems (as the inefficacy of the resocialization o fone the grived, the interruption of his practic criminal as for the escample, the use of the cellular one inside the chains) that surface in the chest of the society. Ireat also of right about the possible solutions for that problematical as the privatization of the system, one biggest and the best use and utilization of the restricteve feathers, the right, na the best applicacition and structuring of the work of the one grieved as the resocialization forms and dignify of the detainee. Nention of the censuses numbers, with the opinion public with regard to the faced situation, as well as, na investigation of the field acieved in the cities of Patos and Sousa, both in the state of Paraiba, in the system of the prision and its solutions. Therefore. A good popularization has booked for the best divulgation for the academic community, with the special address for the one of the area of the sciencs humanities, with the specificity the one of the sciencs of the right, as weel as to the i publish in general, in the faced problem and it supported for the contemporary and it supported for the contemporary and last societies, form the same one it had been implanted to our country.
