| ???metadata.dc.description.resumo???: | A democracia e vista, contemporaneamente, como uma das alternativas de maior relevo e viabilidade para o desenvolvimento das potencialidades imanentes aos seres humanos, enquanto agentes construtores de uma ordem global justa e fraterna. Nesse sentido, esta pesquisa almejou determinar o papel da participação popular na construção da democracia brasileira sob a ótica da Constituição Federal de 1988, bem como o seu enquadramento dentro da evolução democrática de maneira geral; a sua contribuição histórica, social e jurídica para a democracia participativa brasileira; suas formas de manifestação hodiernas e os instrumentos que poderão ser utilizados para torna-la realidade. Com efeito, tais objetivos foram alcançados já na confecção dos capítulos que compõem o trabalho, bem como a confirmação do problema e hipótese previamente elaborados, quais sejam: a participação popular e uma determinante na consolidação da democracia participativa? Sim, os instrumentos constitucionais de participação popular, quando correta e verdadeiramente utilizados, farão consolidar-se a democracia participativa no Brasil. Para tanto, foi realizada uma investigação bibliográfica, utilizando-se os métodos indutivo e exegético jurídico para analise da legislação e da doutrina pátria e comparada. Ressaltou, pois, a perquirição da Carta Magna vigente que proporcionou, com as diretrizes de seu corpo normativo, um grande impulso democrático-participativo em termos formais no Estado brasileiro; porem, no tocante a sua materialização pratica, constatou-se que a democracia do Brasil ainda padece de deficiências graves, necessitando meios eficazes e aptos a colaboração efetiva no seu processo de consolida?ao. Assim sendo, concluiu-se que a participação popular caracteriza-se, atualmente, como um meio propicio a construção e fortificação do regime democrático nacional exercendo, através dos vários instrumentos que tem a sua disposição, o papel de despertar, preparar e educar o povo brasileiro para o desempenho teórico-pragmático de uma democracia plena e consolidada, alicerçada em uma participação consciente e irmanada com os princípios da ordem constitucional em vigor. |
| Abstract: | The democracy is seen, currently, as one of the alternatives of bigger relief and viability for the development of the potentialities from the human beings, while construction agents of a joust and fraternal global order. In this feeling, this research longs for to determine the paper of the popular participation in the construction of the Brazilian democracy under the optics of the federal constitution of 1988, as well as its framing inside of the democratic evolution in a generalized manner; its historical, social and legal contribution for the participative Brazilian democracy; its form of actual manifestation and the instruments that could be used to become it reality. In effect, such objectives are reached already in the confection of the chapters that composes the essay, as well as the confirmation of the problem and hypothesis previously elaborated, which are: is the popular participation a determinative in the consolidation of the participative democracy Yes, the constitutional instruments of popular participation, when correct and truly used, they will make to consolidate the participative democracy in Brazil. For in such a way, a bibliographical inquiry was carried through, using the methods inductive and exegetic legal for analyzes of the legislation and the compared native doctrine. It stands out, therefore, the question of the "effective Great letter" that provided, with the lines of direction of its normative body, a great democraticparticipative impulse in formal terms in the Brazilian State; however, in regards to its practical materialization, it is evidenced that the Brazilian democracy still suffers of serious deficiencies, needing efficient ways and apt to the contribution in its process of consolidation. Thus being, it was concluded that the popular participation is characterized, currently, as a propitious way to the construction and blockhouse its national democratic system exerting, through the some instruments that has its disposal, the "paper" to awaking, preparing and to educate the Brazilian people for the theoretician-pragmatic performance of a full and consolidated democracy, based in a conscientious and spoted participation with the principles of the constitutional order in vigor. |
