dc.description.resumo | O Direito Social a moradia e um direito fundamental e esta previsto no art. 6° da Constituição Federal de 1988. O Brasil possui um grande deficit habitacional, principalmente na parcela da população de baixa renda. O Estado tem a obrigação de dispor de moradia para todos que necessitarem de uma moradia e esta deve atender as condições minimas de sobrevivência, como saneamento básico, infra-estrutura adequada etc. Os direitos fundamentais, conforme §1° do art. 5° da Constituição Federal tem aplicação imediata. Com a violação do direito social a moradia, surge o direito de demanda-lo judicialmente. Diversas normas infraconstitucionais objetivam assegurar e proteger a moradia do individuo. Ausência especifica de instrumentos para a aplicação do direito social a moradia, através das vias judiciais. O Poder Judiciário tem legitimidade para apreciar qualquer demanda, no caso, também pode ser demandado moradias para quem não possui, em respeito ao principio da inafastabilidade da jurisdição. A jurisprudência tem se manifestado no sentido de garantir a moradia para quem precisa e sobreposto o direito a moradia em relação ao direito a propriedade. Precedentes do Supremo Tribunal Federal quanto a possibilidade de demanda judicial e que o Estado tem o dever de dispor de tal direito. A doutrina especializada entende que e plenamente possível exigir do Estado o direito a moradia, através da via judicial, tendo o Poder Judiciário atribuição para interferir nas politicas publicas do Poder Executivo. O método utilizado neste trabalho e o indutivo dedutivo. Existe possibilidade de demanda judicial do direito social a moradia no ordenamento jurídico brasileiro. | pt_BR |

dc.description.abstract | The Right Social of housing is a fundamental right and is provided in Art. 6 of the Constitution of 1988. Brazil has a severe housing shortage, especially in the share of low-income population. The state has an obligation to provide housing for all who need a house and it must meet the minimum conditions for survival, such as sanitation, adequate infrastructure, etc.. The fundamental rights, according to § 1 of Art. 5 of the Constitution are applicable immediately. With the violation of social housing, there is the right to demand it in court. Various standards under the Constitution intended to ensure and protect the individual housing. Absence of specific instruments for the implementation of the social right to housing, through judicial channels. The judiciary is entitlend to enjoy any demand in this case can also be sued for non-housing has, in deference to the principle of inafastabilidade jurisdiction. The case law has manifested itself in ensuring housing for those who need and overlapped the right to housing for the right to property. Precedents of the Supreme Court of the possibility of lawsuit and that the State has the duty to dispose of such right. The specialized doctrine believes that it is entirely possible to require the state the right to housing through the judicial process, and the judiciary to interfere in the allocation policies of the Executive. The method used in this work is the inductive deductive. There is possibility of judicial demand the right to housing in the Brazilian legal system. | pt_BR |
