Abstract

This work aims to investigate the five years of Maria da Penha Law and its effectiveness in Brazilian law, with the research problem: The Maria da Penha Law in the five-year period violates the constitutional principle of equality or just shows up as a legal instrument of protection the woman, bringing a real equality of sexes? This is because the Law Maria da Penha is placed as a subject of intense discussions between different sectors of society and legal researchers. With so much controversy, there are several legal experts and personalities trying to support his point of view about that law. According to the doctrines that will be used, scientific research will be based on the theoretical premise that the Maria da Penha Law combined with a thorough analysis on the law itself and its points that generate divergence in the legal world. This seeks to achieve an understanding of the key points and the innovations brought by the law. The method used is the deductive, it is more efficient in the development of research problems that have consistent and theoretical support, or references.
