Abstract

The problems that affects the Brazilian prison system are not restricted only to large prisons located in large cities. The lack of respect for fundamental principles that underlie human subsistence is obvious. This work seeks to present the current structure of the prison system of the city of Cajazeiras-PB and defiling the rights guaranteed in international and Brazilian penitentiary legislation that occur in detention houses that make up this system. For both uses of the deductive method, through documentary analysis and bibliographic research through theoretical and legal hermeneutical method. Based on field research, using structured interview technique, with questions pre-formulates. Traversing the whole prison system, through the historical development of the prison sentence, applied systems throughout the world, until entering the execution mode of criminal and prison structure offered in Brazil. The Brazilian penitentiary legislation in comparison with international legislation on the subject, presenting the controversial points in common and innovations on topics of greatest relevance in search of socialization. An analysis on the structure of the carceral system Cajazeirense, and implementation of penitentiary legislation guarantees brought in Brazilian and international, through data obtained from field research carried out with the inmates of penal institutions that make up the local prison system. On the data presented and delivered an analysis, it was concluded by the inapplicability of certain rights, emphasizing the inertia of the Government in providing other important guarantees in the life of inmate's city of Cajazeiras-PB.
