???metadata.dc.description.resumo???:	O presente trabalho trata da Adoção Internacional, um dos temas que mais tem causado, atualmente, no mundo jurídico, importantes discussões, sendo, dessa forma, imprescindível, como foco principal, descrever e analisar o Instituto da Adoção Internacional, em um cenário cada dia mais visto e que vem ganhando relevo no ordenamento jurídico brasileiro, como forma de diminuir o numero de crianças e adolescentes que, por diversas razoes, viram-se desamparadas e privadas da convivência familiar. Para tanto, utilizaram-se pesquisas bibliográficas e jurisprudências, textos e artigos publicados, alem de legislações pertinentes ao tema. O estudo se inicia com um breve relato histórico; os conceitos, finalidade, natureza jurídica, função social e efeitos, de forma geral. Aborda-se a legislação aplicada, ressaltando-se a Constituição Federal de 1988, o Código Civil de 2002, o Estatuto da Criança e do Adolescente, bem como o perfil do adotante e do adotado. Posteriormente, analisam-se os tratados e convenções internacionais e, passo a passo, os aspectos processuais e operacionais para a efetivação da adoção internacional, tratando-se, ainda, do estagio de convivência e a excepcionalidade. Destacam-se, ainda, os efeitos da adoção internacional, com relação a família natural e substituta, nome e nacionalidade, os efeitos de ordem patrimonial, bem como abordam-se os crimes, em matéria de adoção internacional, como o trafico de crianças e órgãos, e a "adoção a brasileira". Enfoca-se, também a questão polemica da adoção por casais homossexuais. Destacam-se os resultados que indicam alguns problemas, mas também benefícios, no contexto da adoção internacional, identificando que os estrangeiros não adotam apenas por assistencialismo, e sim, por amor, alem de serem menos preconceituosos que os brasileiros. Por fim, faz-se um convite a reflexão acerca da Adoção Internacional, que e um Instituto jurídico que levanta discussões doutrinarias e exige da legislação pátria, medidas que possibilitem uma maior seriedade e severidade, para melhor atender aos interesses da criança e adolescente.
Abstract:	The present paper deals with international adoption, an issue which has caused important discussions in the legal world today. Thus, essential, being the main focus of this work to describe and analyze the International Adoption institute in a scene increasingly seen and which has been standing in the Brazilian legal system, in order to diminish the number of children and adolescents who, by various reasons, found themselves homeless and deprived of their family. We used to bibliographic researches and jurisprudence, texts and articles published and laws pertinent to the subject. The study begins with a brief historical account, the concepts, purposes, legal, social function and effects in general. It deals with the legislation, pointing to the 1988 Federal Constitution, the 2002 Civil Code, the Children and Adolescents Statute and the profile of the adopter and the adoptee. Later we analyze the international treaties and conventions and step by step the procedural and operational aspects for the realization of international adoption, as it is also the stage of coexistence and exceptionality. It is also noteworthy the effects of international adoption, with respect to natural and surrogate family, name and nationality, the effects of patrimonial order, as well as it approaches the crimes related to the international adoption, such as child trafficking and organs, beyond the understanding of the "Brazilian adoption". It focuses also the contentious issue of adoptions by gay couples. It is noteworthy that the results indicate some problems, but benefits also in the context of international adoption, identified that foreigners do not take welfare, but only by love, and they are less discriminating than the Brazilians. And finally, it is an invitation to reflect on International Adoption, which is a legal institution that raises doctrinal discussions, and the legislation requires homeland measures that allow greater seriousness and severity to better serve the interests of the child.
