A utilização da arbitragem na resolução dos conflitos individual trabalhistas.

Abstract

The present work has the scope to glimpse the benefits afforded by the use of the institute of arbitration as alternative means of resolving individual labor conflicts in order that the work justice, in our times suffers from the slowness of its decisions, compared to the huge number of processes currently this harvest of the Brazilian judiciary. In this context, it is clarified to demonstrate the various ways of resolving conflicts between them: Collective Bargaining, Conciliation and Mediation, by making the necessary distinctions with the concept of arbitration in order to investigate the advantages and effectiveness of using this institute in the collective and individual labor bargaining. In this vein, it is highlighted questions concerning to the constitutionality of the institute, the importance of access to justice, and flexibility of the labor rights, as well as the implementation of the arbitration clause and arbitral commitment in the individual labor conflicts. In what concerns to the methodology, it was chosen for the inductive method, and resorted to the use of bibliographic research and examination of the jurisprudence decisions about the subject.
