Abstract

This study examines the benefits of continuous social protection as an instrument of Social Security in order to combat hunger and social exclusion. It presents the development of social protection in the world and the reforms of the retirement systems in the countries that make up the MERCOSUL. The study aims to understand the effects of the current economic model for the protection of the human rights and for the respect of human dignity. It analyses the inclusion of the social rights in the category of fundamental human rights and the International Covenant of Economic, Social and Cultural rights. The study is based on bibliographic research of literature concerning constitutional law, international treaties and retirement law. It describes the costs of the Social Security budget and shows that it has only managed a balance by reducing the public social policies to a minimum. The study concludes that the access to continuous social benefits meet economic and politic obstacles when they are offered by the State and this hinders the fulfillment of the social rights. But, the study argues, the right to an existential minimum cannot be transferred to a secondary priority because of economic factors, as that would imply social regression and suppression of social norms.
