Direito ambiental: uma evolução da legislação de resíduos sólidos no Brasil.

Abstract

The present monographic work aims to present the evolution of solid waste legislation in Brazil, explaining the socio-environmental factors responsible for gradual regulatory activity, as well as weaving a comparison between formal law and infra acts. Moreover, it is used the hermeneutic-legal method, to organize guidelines, values and principles needed to epistemological development, and to facilitate the application of the interpretive technique. In our times, against the evidence that the planet's natural resources are finite, there is a latent need for change from the summits of power to the base of civil society. The increasing of world population and the changes in their consumerist habits resulted in a significant increase in the volume of solid waste and proper disposal of these wastes is one of the great challenges facing humanity. If not taken proper procedures for pollution control, solid waste represent a public health risk, especially to people disadvantaged by the political-economic model. It is weighed about the environmental consequences of disposal of solid waste, demonstrating the effects of soil, air and water, contamination, as well as the inherent risk to flora and fauna, which in one way or another reflect the human being. It is portrayed the issue of solid waste in Brazil, approaching the legislation and carrying out a systematization of the rules comparatively within the timeline that follows from 1981 to 2010. Thus, it culminates in the approach of the National Solid Waste, created by Law No. 12.305/2010, bringing to stage the main concepts, classifications and innovations on the regulation of solid waste, emphasizing the issue of shared responsibility and reverse logistics.
