A violência sexual intrafamiliar contra a criança: formas de combate e prevenção.

Abstract

Since the ancient times until today, the child has been targeted for various forms of violence and mayhem in several aspects: physical, sexual, spiritual and psychological, all of these cause serious consequences to the lives of children, but sexual violence is the most detrimental to the development of these victims. Being observed even in the family home, which is the focus of this work. You can assign as a cause of sexual violence within the family, lack of protection of fundamental rights of the child and the lack of a proper family life throwing the child in a situation of risk and consequent helplessness due to their fragility in the face of violence perpetrated within familiar. In this context the objective is to demonstrate that sexual violence within the family is the most common and involves a child or adolescent and an immediate family member or very close. In preparing this work we used the method of hypothetical-deductive approach, the procedure and comparative-historical exegetical and legal and technical literature, in the analysis of ways to combat and prevent violence suffered by children, showing that there is still a immeasurable gap between the legislation available to protect the child and their effective application by the state, requiring the support of various sectors of society for this intrafamily sexual violence against children will not go unpunished. Moreover, it is perceived that the development of public policies and their implementation and enforcement are key to solving this significant public health problem. Although it is not easy to develop mechanisms to combat and prevent sexual violence within the family, it appears that several effective tools to combat this, they already exist, although it is still needed its efficient implementation and monitoring. The current civilizations have evolved a legal system, coupled with greater access to information, a combination that excites a greater demand for justice, for immediate changes to eradicate impunity, social tolerance, the omission of the state and society, ending the funding of crime against children, neglect and lack of respect, referring to sexual violence within the family against children and adolescents.
