Abstract

This research examines the right to privacy in the face of the internet. Therefore, the issue of this study is to understand whether and how the right to privacy, as part of fundamental rights is ensured normatively face of technological developments in relation to information technology. The goal is to expose the right to privacy and to analyze its characteristics, content and limitations, showing its fragility in the face of computerization. Therefore, justification of the work under review unfolds before you the right to privacy is enshrined as a fundamental right in the Constitution of 1988 and is secured in art.5 °, X. It is therefore necessary to verify that the Brazilian legal system to keep pace imposed by the science of technology, since it evolves at exorbitant rate. For as we know, are a growing number of cases in which intimacy is violated through the use of computers and thus it is necessary to guarantee explicitly and effectively to this basic right. However, it is clear that the Brazilian laws are obsolete part listed on the problem, which needs an overhaul and standardization so that the right to privacy must not be forgotten and become increasingly fragmented.
