???metadata.dc.description.resumo???: O objetivo principal do presente trabalho tem como escopo fazer uma analise objetiva e crítica sobre a possibilidade de aplicação de penas restritivas de Direito aos condenados pela prática de crimes hediondos, primordialmente com observância das leis 9.714/97 e 8.072/90, onde hoje predomina no meio juridico uma polemica bastante extensa a cerca da questão que aqui se propõe, onde na maioria das vezes se entende por nao haver possibilidade de tal substituição, em face do tratamento mais rigoroso que se pretende dar aos condenados pela prática de crimes hediondos, o que seria incompativel com as Penas Restritivas. E de suma importância mencionar que no campo da lesividade os crimes hediondos e equiparados ao contrário do que se tem na prática, não apresentam o mesmo grau de reprovabilidade no meio social, o que se torna uma fantasia legal querer determinar que tais crimes possuem a mesma forma de execução e a mesma caracteristica dos executores, o que verdadeiramente não é verdade. No desenrolar desta controvêrsia surge o STF em julgamento de ADIN, no ano de 2006 entendendo pela possibilidade de progressão de regime aos condenados pela prática de crimes hediondos, fazendo com que mais tarde seja editada a lei 11.464/07 para regular esse entendimento, além da já constatada contradição presente na Lei. 8.702/90, que após determinar no já tão famoso § 1 ° do artigo 2° que a pena deve ser cumprida em regime integralmente fechado, logo em seguida diz que cumpridos dois terços da pena e nao havendo reincidência especifica o condenado podera receber o beneficio da liberdade condicional, faz-se presumir mais tarde que existe compatibilidade entre os institutes aqui estudados, visto ter caido por terra a necessidade de cumprimento da pena em regime integralmente fechado. Este trabalho foi consubstanciado atraves de um estudo histérico, bibliográfico, e atraves de contatos com profissionais aplicadores do direito, onde buscou-se delimitar a que nível se encontra esta possibilidade de aplicação de penas restritivas e a repercussão da aplicabilidade no meio juridico e social.
Abstract: The main objective of the present work has as target to make an objective and critical analysis on the possibility of application of Restrictive penalties of Right to the convict for the practical one of hideous crimes, primordially with observance of laws 9,714/97 and 8,072/90, where today it predominates in the legal way a sufficiently extensive controversy about the question that if considers here, where most of the time if understands for not having possibility of such substitution, in face of the treatment more rigorous than if it intends to give the convicted for the practical one of hideous crimes, what it would be incompatible with the Restrictive Penalties. It is of utmost importance to mention that in the field of the lesividade the hideous and equalized crimes in contrast of what if it has in the practical one, the same do not present degree of reprovabilidade in the social environment, what if it becomes a legal fancy to want to determine that such crimes possess the same form of execution and the same characteristic of the executors, what truily it is not truth. In uncurling of this controversy the STF in judgment of ADIN, the year of 2006 appears understanding for the possibility of progression of regimen to the convict for the practical one of hideous crimes, making with that later law 11,464/07 is edited to regulate this agreement, beyond already evidenced present contradiction in the Law. 8.702/90, that after to determine in already so famous § 1° of the article 2° that the penalty must be fulfilled in integrally closed regimen, immediately afterwards says that fulfilled two tercos of the penalty and having specific contumacy the convict will not be able to receive the benefit from the conditional release, becomes to presume later that exists compatibility enters the studied Justinian codes here, seen to have fallen for land the necessity of fulfilment of the penalty in integrally closed regimen. This work was consubstanciado through a historical, bibliographical study, and through contacts with professionals applicators of the right, where it searched to delimit the one that level if finds this possibility of application of restrictive penalties and the repercussion of the applicability in the legal and social way.
