Abstract

The central idea of the work is to identify, through the legal system laws, protection of the family matrimonializada and its property when the family peace and stability, are threatened by the existence of the adulterine concubinage. The search starts with the brief overview of the origins of the family and concubinage and extends up to today, explaining the evolution of the position both as social basis regarding the existence of concubinage. Do the explanations the development of relations concubinages and establish limits of tolerance based on the family structure in order to prevent social injustice, explaining the necessary points of disagreement and concepts used in the course of work. For the development of the work, is used searches doctrinaire, legislative, constitutional and, most importantly, legal. In view that the principle more injured by the granting of rights to concubinage is the principle of monogamy, full important for preservation of families. Not forgetting to establish more points of disagreement rolling for couples: the adultery. He ended his presentation of the results, pointing the authority of the family heritage and explaining the current legal position with regard to increasing rights granted to adulterine concubinage.
