Redes sociais e liberdade de expressão: um estudo de caso de repercussão nacional.

Abstract

This work intends to report, in a systematic way, the problematic of social media and the freedom of expression, being this first one, very used and diffused in the present time, not restricting only in the relations of the individuals, nevertheless the media has been every day, assiduously, present in human relations. The work presents freedom of expression as an important constitutional right, thus pointing out that free expression of opinion can not exceed and consequently harm the rights of the individuals. The problem addressed in this work is concerned with the exercise of this right, which by exceeding it or exercising it in bad faith, often results in unlawful acts. Social media has its uses, so it provides its immense public with entertainment and information in an agile way, since its diffusion is precise and its reach is practically unquestionable. Because of its free character, in fact everyone can access it, social media has become a vulnerable scenario for illicit practices, and these crimes, considered virtual, are often insoluble by the lack of a law that produces effects in an agile way and needs, especially when the nature of these criminal acts injures the honor of the individual and attacks him degradingly. Regarding the methodology used, case study was based on journalistic sources, study of scientific articles, doctrine, laws and jurisprudence. The main contributions are based on the importance of the theme for the Brazilian conjuncture, and, especially, the adjection for themes of significant collaborations, and to improve the knowledge and investigations with the intention of detailing the studies related to social media and the limits of freedom of expression.
