Sistema penitenciário e sua função ressocializadora.

Abstract

The problem concerning the resocialization of the prisoner front to the current penitentiary system is one of the sore spots that more it afflicts the society, before this, it's made an abbreviation historical of the origin of the private feather of freedom, as well as of the purposes to be reached by it execution, the theories that are in charge of the theme and the following positioning for the structures juridical national appearing. The models of penitentiary systems adopted at several countries are described, characterizing them from the first ones be implanted until used at the present time, in way to evidence the system adopted in Brazil. It's verified that the problem of the Brazilian penitentiary system goes very in addition is shown and maybe for that it is such a delicate and controversial subject. Several initiatives are put into practice, however they are questioned by the fact that the situation of the penitentiary system tends to worsen and the prisons formerly considered "schools of the crime" develop for "universities of the crime". More and more, that if it turns a problem of all, and to ignore such situation is to contribute so that there is more revolt, revenge and indignation. No there is recovery, appropriate feeding, and application of the human rights, dignity or respect; there are shame, humiliation and indifference. For the attainment of the study text of practical stamp was elaborated, through the research methods exegesis juridical, historical evolutionary and deductive. This way, the larger objective of this scientific research is to show that it is public and well-known the bankruptcy of the Penitentiary System in the process of resocialization of the condemned, before the prisoners' revolt that observe their disrespected rights and no accomplished according to the Law of Penal Execution and the Federal Constitution.
