A progressão de regime e o paradigma da ressocialização prisional.

Abstract

The objective of the present study consists of drawing a vision criticizes concerning the institute of the regime progression by the study of his/her main ideological theme, haul of drawing the aspects main critical aspects involving the same. For that, it was used as research technique the bibliographical revision of the doctrine and of the involved legislation being used as approach method the processes deductive, historical and analytical. In the first chapter it will be approached the historical roots involving the theme, with emphasis to the study of the appearance of the private feather of freedom while precursor of the regime of progression prisoner. Later the basic aspects will be drawn involving the call model of resocialization prisoner, faced here as the ideological base to the model of regime progression. To proceed, it will be approached the critical aspects involving the thought ressocializator, especially as the multiplicity of decisive factors practices her/it of the criminal action in itself besides the study of the victim's paper in the criminal phenomenon. At the end the adopted criteria will be reviewed the conscious of the benefit of the regime progression being emphasized the absence of an adapted criterion the effective social reality, with special focus to the problem of the it increases of the criminality.
