Abstract

The purpose of this paper is to discuss the necessity and use of the International Criminal Court to prosecute and prosecute criminals who commit barbaric crimes against the dignity of the human person. Depriving prerogatives, privileges of certain agents that before some National legislations, would not have a fair trial. It aims to show the importance of this Tribunal to the international community, as an instrument for the protection of human rights. And its use in favor of the International Criminal Jurisdiction, in the face of the need to punish criminals, and to bring human dignity to the victims to resume their lives. We used the deductive method, and the critical descriptive procedures, through direct bibliography documentation, from the analyzes of doctrinal works, scientific articles, and legislation. It is understood that the Rome Statute has a wide discussion about its acceptance and ratification by the great world powers. Its relationship with the UN Security Council has contributed to the creation of the Court, and gradually it is expanding its field of activity, thus promoting the country's laws. In this way, the International Criminal Court made it possible for people who used prerogatives to be tried in the national courts to have a fair trial before the International Court, increasing the guarantee and respect for human rights.
