A violência sexual intrafamiliar contra a criança e ao adolescente.

Abstract

Since the colonial period, Brazil recorded stories of violence perpetrated against children, who were not considered subjects of rights, but subject to believe resulting from parental custody. Hodiernal, in legislative terms you can say, with regard to the population under the age of eighteen years, that Brazil has modern instruments, capable of facing the challenges imposed by various forms of violence in the lives of children and adolescents on all the interfamily violence. Have it in front of the problem in question, these tools are not effective. The increase in complaints of this kind of violence that has drawn the attention of society and public authorities. What emphasizes the importance of knowing the characteristics and individuals involved in interfamily sexual abuse as well as studying their inclusion in the legal system and its repressive aspects, and preventive care. In face of the above: what the real situation of interfamily violence in Brazil? Would in fact, the Brazilian law guaranteeing the protection of children and adolescents in the face of interfamily violence? The purpose of this study is to identify the interfamily violence, their typology against children and adolescents, trying to understand what is behind this kind of violence, its concepts, which mainly features and the treatment given by law to this type of violence that both worries us and shame. In preparing this work will be adopted as methods of the study exegetic-legal, by which will be held to legal doctrines and sites with the aim of enriching and hear the discussion on the topic in question, and historical and evolutionary method, with the scope demonstrate how the child has been spread over time until the present day. The twenty-first century shows that much of what is captured in the letter of the law, is yet to be realized in practice, the century by supplicates changes immediately, which break with issues of impunity, social tolerance, acceptance and trivialization on a global scale and striking the question of interfamily violence.
