A construção da cidadania homossexual através dos direitos humanos.

Abstract

The homosexuals are constantly infringed in their rights while citizens, no matter how much they are them insured, in the theory, values of the Human Rights as the equality, freedom and dignity, these same values they are taked, in the custom. This work intends to show that the homosexuals don't exercise his/her right to the full citizenship, according to the speech of the Human Rights. The historical-evolutionary and exegeticjuridical method was used, using of vast bibliographical research. The results were that the homosexuality constitutes a reality that always existed in the humanity's history, but the interests of those that only look for the respect to his/her sexual personality are constantly hindered by the individual interests of groups discriminatory, invalidating, like this, the words written sixty years ago in the Universal Declaration of the Human Rights. In practice, the one that prevails is the prejudice and the discrimination, and the people homosexuals are played to the margins of the society, not could exercise his/her right of having rights, for they have chosen for they be happy and they exercise the sexual identity that the life necessarily imposes all. While the Brazilian State not to recognize the rights of the homosexuals fully and to check them dignity, freedom and equality, the Federal Republic of Brazil will lose one of their foundations: the citizenship. The homosexuals only want to be citizens free, same, worthy, and, above all, happy.
