Proteção Jurídica nas relações poliafetivas.

Abstract

The main purpose of this study is to demonstrate the feasibility of legal recognition of family relationships based on polyamory. These unions are known as poliaffective or polyamorous relationships which comprise a form of relationship in which it is understood that it is valid, possible and compensatory to maintain, in general for long periods of time, intimate, sexual and / or loving relationships with more than one person simultaneously. Provided that there is consent by all parties involved in this mode of relationship because, primacy and respect for the dignity of its members. Based on the affection that is considered the link responsible for justifying the contemporary family, stimulating the realization of the individual in the search for the ideal of happiness. It is necessary to understand the concept of family and its changes over time, allowing the identification of several existing models. Among them, stable unions deserve special attention in the elements that distinguish it as a family entity. In order to adjust the focus to the polyphonic unions, we try to validate them before the fundamental precepts of family institutions. For this, the present work adopted the deductive method as a way of approaching the theme to reach a final understanding based on the data collected through a bibliographical research. Finally, to verify that the emergence of new models of families, only translate the changes resulting from the social dynamism that, usually, precede the own right positive. In this sense, free family structures arise that do not need the seal of marriage to ensure the validity of these relationships. Giving attention to the freedom that each one has of constituting a family in the way that fulfills their desires. To do so, to establish the possibility of the State commitment to receive in the legal order of the country these new models of family entities for the purpose of ensuring the isonomic treatment of access to the protection of Family Law.
