| ???metadata.dc.description.resumo???: | A pesquisa cientifica tem como finalidade, discorrer sobre o instituto da união estável no Brasil, fazendo um apanhado geral, mostrando sua evolução no cenário normativo, como se deu sua legalização, os requisitos para a sua existência, e principalmente os efeitos que geram tal união. Foi apos a Constituição de 1988 que a união estável ganhou status de entidade familiar, onde o Estado garantia sua proteção na esfera jurídica e a conversão em casamento.O legislador não poderia ficar inerte aos inúmeros casos de uniões fora do casamento, com a criação de leis que regulamentaram a união de fato, surgiram diversos efeitos, obrigações, direitos e deveres entre os companheiros.As atenções dadas pela doutrina e jurisprudência nacional para tentar solucionar as obscuridades e lacunas deixadas pelas leis que regulamentam a união estável são indispensáveis para um perfeito esclarecimento do assunto.Ao final se procura aumentar o debate sobre instituto da união estável e sobre as leis que foram criadas para a regulamentar da união de fato, com o escopo de preencher as lacunas existentes na lei, bem como alargar os conhecimentos dos operadores do direito para que estes possam solucionar possíveis celeumas jurídicas que envolvem a união de pessoas fora do casamento. |
| Abstract: | Scientific research aims to discuss the institute of stable union in Brazil, making a general overview, showing its evolution in the normative scenario, how it was legalized, the requirements for its existence, and especially the effects that generate such a union . It was after the 1988 Constitution that the stable union gained status as a family entity, where the State guaranteed its protection in the legal sphere and the conversion into marriage. The legislator could not remain inert to the countless cases of unmarried unions, with the creation of laws that regulated the de facto union, several effects, obligations, rights and duties arose among the companions. Finally, the debate on the institute of the stable union and on the laws that were created to regulate the de facto union, with the aim of filling in the gaps in the law, as well as broadening the knowledge of the legal operators so that they can resolve possible legal disputes that involve uniting people outside of marriage. |
