O problema começa desde o nascimento, se prolongando ao longo da vida da maioria da população. Um desses direitos violados tinha origem já quando existia a necessidade de se fazer o registro de nascimento, ocasionando um grande número de crianças sem registro, sendo outro grande problema a paternidade não declarada, quando registradas.O primeiro problema foi resolvido pela Lei n° 9.534/97, que deu nova redação ao art. 30 da Lei n° 6.015, de 31 de dezembro de 1973, que dispõe sobre os registros públicos, criando a gratuidade para o registro de nascimento. O segundo problema, bem mais complexo, foi combatido pela Lei n° 8.560, de 1992, que trata da ação de investigação de paternidade dos filhos havidos fora do casamento. 0 presente trabalho visa a pesquisar a eficacia da Lei de Investigação de Paternidade (Lei n° 8.560/92) na Comarca de Sousa, formada por nove municípios, pela pesquisa de campo nos cartórios de registro de pessoas naturais, através de entrevista com os respectivos oficiais de registro, bem como com representantes do Ministério Público e Judiciário ligados a matéria, e o Conselho Tutelar da cidade de Sousa. |
| Abstract: | The violation of basic citizen's rights is a serious and recurrent problem in Brazil. It usually starts at birth and extends during the life of great part of the population. The earliest right to be violated concerns birth registration, which leads to an increased number of children with no birth certificates, as well as unknown paternity, when these children are registered.The former problem was effectively solved by the Law n° 9.534/97, which gave a new text to the Article 30 of the Law n° 6.015 of 31 December 1973. It disposes of public registrations, stipulating free application to birth certificates. The latter issue, far more complex, was referred by the Law n° 8.560 of 1992, which regulates the paternity of the offspring bom outside marriage. The present work aims to investigate the effectiveness of the law of paternity investigacion (Law n° 8.560/92) in the Comarca of Sousa, which is formed by nine municipalities. The resarch has been conducted by field investigation in local register offices, by interviewing its officers as well as other representatives from the Judiciary and Public Ministry, and the Tutelary Council from the municipality of Sousa. |
