O estudo baseia-se no método dedutivo e utiliza como técnicas de pesquisa, a pesquisa documental e a pesquisa bibliográfica. Preliminarmente, apresentam-se noções gerais sobre a relação contratual, minudenciando o conceito de relação de consumo e seus polos, consumidor e fornecedor. Aborda-se uma visão geral sobre os tipos de contratos de consumo, tratando ainda sobre a revisão contratual nas relações consumeristas. Por fim é realizado análise da súmula 381 do Superior Tribunal de Justiça e os efeitos da negação da tutela do Estado em relação a contratos com instituições financeiras com juros abusivos e encargos ilegais. |
| Abstract: | The present study aims to analyze the general aspects of the review of consumer contracts, as well as the analysis of the STJ's summary no. The study is based on the deductive method and uses as research techniques, documentary research and bibliographic research. Preliminarily, there are general notions about the contractual relationship, minimizing the concept of consumer relation and its poles, consumer and supplier. An overview of the types of consumer contracts is discussed, as well as a review of contractual relations in consumer relations. Finally, an analysis of the Supreme Court's 381 summary and the effects of the State's denial of trusteeship regarding contracts with financial institutions with abusive interest and illegal charges are carried out. |
