???metadata.dc.description.resumo???:	A convivência dos seres humanos com os animais subsiste há milhares de anos e acompanha o desenvolvimento humano. Os animais já foram utilizados pelos humanos de diversas maneiras. No princípio, eram utilizados para a caça, a coleta, a domesticação, para subsistência e na agricultura. Deixando de ser usado na produção, por um lapso temporal de tempo, para ser tido como uma figura sagrada. É necessário que o homem tenha a consciência que é possível a interação com os animais sem que para isto tenha que submetê-los a maus tratos ou experiências cruéis. Leis são criadas na tentativa de minimizar as práticas inadequadas que causam sofrimento aos animais. Existe, no ordenamento jurídico brasileiro, a Lei federal nº 9.605/98, que versa a respeito dos crimes ambientais, porém, ainda há muito que se aprimorar em termos de legislação e conscientização para que os animais passem a ter um tratamento digno. Assim, o presente trabalho tem como objetivo analisar a eficácia da aplicabilidade da já citada lei no que tange a proteção em relação aos animais domésticos. Os animais são passíveis de direito e merecem tanto respeito e cuidados quanto o próprio ser humano, por possuírem um mesmo direito inerente a todos: a vida. Sendo assim, esta pesquisa foi pensada para ajudar na solução da problemática em questão, trazendo uma leitura fácil e de eficaz aplicação na prática. Utilizar-se-á o método dedutivo, onde serão elencadas as considerações de doutrinadores e da legislação atual, com ênfase no direito dos animais, fazendo uso, principalmente, de revisão bibliográfica.
Abstract:	The coexistence of human beings with animals subsists for thousands of years and keep up with human development. Animals have been used by humans in many ways. In the beginning, they were used for hunting, gathering, domestication for subsistence and agriculture. It ceases to be used in production, for a temporal lapse of time, to be regarded as a sacred figure. This paper deals with protection, which has been undergoing violations for years, and the evolution of animal rights. It is necessary for man to realize that it is possible to interact with animals without having to subject them to cruel mistreatment or experimentation. Laws are created in an attempt to minimize centuries of inadequate treatment and animal suffering. There is, in the Brazilian legal system, Law 9,605 / 98, which deals with environmental crimes, but there is still much to be improved in terms of legislation and awareness so that animals can receive a decent treatment. Animals are entitled to rights and deserve as much respect and care as human beings themselves because they have the same inherent right to all: life. Therefore, this research was designed to help in solving the problem in question, bringing an easy reading and effective application in practice. The hypothetical-deductive method is used, where the considerations of doctrinaires and current legislation are emphasized, with emphasis on animal law, making use, mainly, of bibliographical revision.
