dc.description.resumoO presente trabalho de conclusão de curso visa esclarecer a dúvida existente sobre a legitimidade do artigo 20 da Lei Maria da Penha (Lei n° 11.340/2006) no que se refere ao cabimento da decretação de ofício pelo Juiz da prisão preventiva na fase do inquérito policial em contraposição à previsão trazida pelo Código de Processo Penal que dispõe que o Juiz só poderá decretar a prisão preventiva de ofício se no curso da ação penal. Para isso, aborda aspectos históricos concernentes à concepção da Lei Maria da Penha bem como analisa o instituto da prisão preventiva, enquanto medida cautelar, em todas as suas peculiaridades. Durante o trabalho vamos fazer uma análise dos princípios que norteiam a temática, analisar de maneira pormenorizada o instituto da prisão preventiva e por fim verificar a (in)constitucionalidade do art. 20 da lei maria da penha. A metodologia adotada é o método dedutivo, a técnica de pesquisa é a pesquisa bibliográfica e documental. Temos como hipótese que há um possível conflito de normas entre o artigo 20 da lei maria da penha e o código de processo penal trazendo grande insegurança jurídica a sociedade. Como considerações conclusivas temos que o referido dispositivo é flagrantemente inconstitucional frente ao princípio constitucional da presunção de inocência.pt_BR

dc.description.abstractThe present course conclusion work aims to clarify the existing doubts about the legitimacy of article 20 of the Maria da Penha Law (Law n ° 11.340 / 2006 with regard to the fitting of the decree of ex officio preventive detention by the judge during the police investigation phase in contraposition to the prediction brought by the Code of Criminal Procedure which provides the Judge can only order preventive custody ex officio if in the course of the criminal action. To this, it addresses historical aspects concerning the conception of the Maria da Penha Law as well as analyzes the institute of preventive detention, as a precautionary measure, in all its peculiarities. In the course of the study, the legitimacy of Article 20 of Law 11340/2006 is clear, since this is subject to the requirements contained in article 312 of the CPP. The relevance of the study here is shown in the clarification of the doubt generated around a possible normative conflict. To obtain the results the deductive method was used, using a bibliographical and virtual research technique, using as sources the Constitution, infraconstitutional legislation, jurisprudence and specialized doctrines, as well as scientific articles, journals and reading texts about the problematic. Finally, it is concluded that the generating doubt article is legitimate and its application aimed at a specific situation so it does not contradict the current criminal procedural law.pt_BR
