Abstract

The developed work, with denomination "The Transexual and the right to the change of name and a new sexual identity", approaches problematic current, controversial and an intricate one: "The Transexual and the right to the change of name and a new sexual identity". The relevance of such study justifies in the present time and complexity of this so controversial subject, that it consists in a true legal-social taboo and a challenge for the interpreters and applicators of the right. It is intended, with uncurling of this study, analyzing the question of the transexualism, approaching the importance of the sexual identity (and salutar sexual identification, is standed out) for the individual that lives in society, pondering on the surgery of sex change (change of genital surgery) and its consequences in the world of the right (crossing for the doctor-legal aspects). The Project of Law will be approached in concise way n° 70-B/1995, a light blow of modernity that hangs on the thematic one, and will be made concise comparison between the Brazilian right and foreign orders. Some real cases (and celebrities will be brought the fire, of great repercussion) of transexuais, as Roberta Close, in order to show the social conflict, and the worse one of all, the faced internal conflict daily for the transexual. Finally, it will be analyze redesegnation of the transexual and the possibility of the respective modification in the birth seat, glimpsing itself it question for the perspective of the nominal alteration to consist a form of the transexual to exert of full form its citizenship, ever presents theoretical character, having been adopted the methods deductive and comparative, allies to the bibliographical research.
