| ???metadata.dc.description.resumo???: | O presente trabalho visa esclarecer o entendimento jurisprudencial e doutrinário, majoritários, no que tange ao momento adequado para o juiz exarar o despacho saneador, mostrando quais as situações que ele deve ser exarado oralmente e por escrito, como se desenvolve a fase de saneamento ou providencias preliminares, abordando essa atividade não como uma fase processual tipica, mas como uma função do diretor do processo, que deve ser exercida com observância aos princípios norteadores do processo. Objetiva, ainda, analisar o que acontece quando aparece nos autos uma ação declaratória incidental, quando ha necessidade da audiência preliminar e quando esta e desnecessária, tudo para garantir o desenvolvimento valido e regular do processo. |
| Abstract: | The present work seeks the research of the understanding of the tribunals and of the doctors of the majority law regarding which the moment adapted for the judge to place the ruling of cleaning up, in that situations he should do vocally or in writing, as the phase is developed of correcting or preliminary providences, approaching that activity doesn't eat a typical phase of the process, but as a function of the director of the process, that should be exercised with observance of the beginnings that involves the process. It objectifies, still, to analyze what happens when it appears inside of the process the action that should declare the one of right, when there is need of the preliminary audience and when this is unnecessary, everything in reason of guaranteeing the valid and regular development of the process. |
