A justiça restaurativa como perspectiva de proteção ao adolescente em conflito com a lei.

Abstract

Considering that restorative justice offers a new model of accountability that is consistent with the doctrine of Integral Protection, since it is based on dialogue between the parties and in the repair of the damage, without the stigma of adolescents in conflict with the law, in order to restore ties and ensure social peace, search on "restorative justice as protection perspective adolescents in conflict with the law". This monographic work aims at the eventual to analyze if in fact it is possible to implement full protection under which the infant is inserted through the restorative methods. It is necessary to observe the situation of adolescents in conflict with the law, as well as investigate whether to ally with the application of socio-educational measures both concern themselves primarily with the educational character, not just with the punitive and at the end, introduce restorative justice as an alternative means of conflict solution. Performs a search-centric technical studies and bibliographical research, such as in indirect documentation, aiming to demonstrate the fundamental theoretical, doctrinaire and case law involving the subject, through the method deductive approach. It appears then, that restorative practices fix the damage, the young labour in conflict with the law and restore the community ties, which enforces the fact that restorative justice is able to resolve conflicts without hurting the integral protection given the teenager.
