Intervenção federal no Brasil: uma análise sob a égide do princípio da autonomia politica dos entes federados.

Abstract

The social organization and the constitutional precepts, presents a very intimate relation. Considering, above all, the rumors taken by the Brazilian State, with the adoption of Federative Agreement as state form. In that way, the autonomy shows himself as an important element of Brazilian society in many different areas, especially with the entities that compose the Union and that it reigns de Federative Agreement. In those lines, that develops the present study itself: bringing an exception to the autonomy firmed on Brazilian principles a consubstained in the Federative Agreement: the Federal Intervention. An important dispose created by constitute legislator back to the guarantee of Union objectives and interests, allowing the intervention, repeats, in extraordinary way. To that, adopted as general objective: analyze the hypothesis of confront to Federative Agreement, surpassing the most important ways of federal intervention in Brazil´s legal order. In addition, as main objective: a. search for the single aspects: the problematic investigation involving the possibility of autonomy usurpation of Federal Entities. b. the case study about the institute in question, lining the federative agreement focus of Federal Constitution, passing by the superior jurisprudence; c. the analysis of correlation between Intervention and democracy. Adopting to that, a bibliographic methodology and realizing the work division in three chapters: the character of general elements that includes the Federal Intervention; the disposal presentations and nuances of Federal Intervention; and the positions and effects that the Federal Entities suffers after that device. As a result, the present task concludes about the hypothesis of autonomy usurpation of entities in part of institute in discussion.
