| ???metadata.dc.description.resumo???: | O crime organizado é uma das facetas da criminalidade que preocupa legisladores e Estados em todo o mundo, seu crescimento é notório, assim como as tentativas de combatê-lo. Ele não está presente somente nas ruas, mas também dentro das unidades prisionais. O crime organizado só é possível porque existe uma grande omissão do Estado, uma falta de controle, sai-se da ideia de Estado Paralelo e passa-se a ver como o próprio Estado contribui. A segurança pública através do encarceramento desenfreado tenta trazer a população uma sensação de conforto ao demonstrar que estão se prendendo cada vez mais, mas acaba por se tornar apenas um paliativo, já que desencadeia outro problema que é a superlotação das unidades carcerárias, dificultando a individualização da pena e o cumprimento do objetivo ressocializador. A análise desse problema é necessária para que se possa combater o crime organizado, e entendendo a relação da superlotação com a perpetuação das organizações criminosas é possível buscar soluções. Para execução da presente pesquisa, utiliza-se o método indutivo, buscando informações pormenorizadas com intuito de um alargamento no que se pretende mostrar, como também, a pesquisa bibliográfica, levando-se em consideração a atualidade do sistema jurídico do Brasil, além da análise do processo histórico que levou à construção dessa realidade. Tendo como objetivo revelar as reais causas e consequências da superlotação das unidades penitenciárias e sua implicância no crime organizado e possíveis alternativas para solucionar tal problema. Através dessa investigação pode-se perceber que a superlotação contribui diretamente para a manutenção do crime organizado, cujos dados que se apresenta são preocupantes, tornando-se necessário que o Estado invista mais em políticas carcerárias, pois só prender e não ressocializar não demonstra tanta efetividade. Nota-se que o descaso com as unidades prisionais sempre esteve presente na história e apesar do caráter humanizador da Constituição e das garantias acertadas na Lei de Execução Penal a realidade vem se mostrando na contramão dos Direitos Humanos. |
| Abstract: | Organized crime is one of the facets of crime that worries lawmakers and states around the world, its growth is notorious, as are attempts to combat it. It is not only present in the streets, but also inside the prison units. Organized crime is possible only because there is a great omission of the State, a lack of control, it leaves the idea of the Parallel State and it is started to see how the State itself contributes. Public security through rampant incarceration tries to bring the population a sense of comfort by demonstrating that they are holding on more and more, but it ends up becoming only a palliative, since it triggers another problem that is the overcrowding of the prison units, hindering the individualization of the pen and the fulfillment of the resocializing objective. The analysis of this problem is necessary to combat organized crime, and understanding the relationship between overcrowding and the perpetuation of criminal organizations is possible to find solutions. In order to carry out the present research, the inductive method is used, searching for detailed information with a view to an enlargement in what one intends to show, as well as the bibliographical research, taking into account the current Brazilian legal system, besides the analysis of the historical process that led to the construction of this reality. With the objective of revealing the real causes and consequences of the overcrowding of the penitentiary units and their implication in organized crime and possible alternatives to solve this problem.Through this investigation it can be seen that overcrowding directly contributes to the maintenance of organized crime, whose data is worrying, making it necessary for the State to invest more in prison policies, because only arresting and not resocializing does not show as much effectiveness. It is noteworthy that disregard for prison units has always been present in history and despite the humanizing nature of the Constitution and the correct guarantees in the Criminal Enforcement Law, reality has been shown against human rights. |
