Abstract

This research deals with the right to education by analyzing how the inclusion of children and adolescents with Down syndrome occurs in the public school system in Brazil. The general objective of the research is to analyze how the inclusion of children with Down syndrome occurs in the public school system in Brazil and the repercussions of the Disability Statute regarding the effectiveness of this right. Specifically, it is proposed to investigate the historical evolution of the protection of people with disabilities in Brazil, with a view to understanding Down's Syndrome; To analyze the right to education and the perspectives of inclusive education in Brazil; To critically reflect on the innovations of the Disability Statute regarding education and its application to the situation of the child with Down Syndrome. The methodology used for the construction of the work was based on different methods of approach, the main ones being the deductive, the qualitative, and the bibliographical, developed from the use of research and studies through a specialized bibliography and collection of books, scientific articles , specialized journals, as well as the Brazilian legislation pertinent to the treatment of persons with disabilities, with emphasis on children with Down Syndrome, despite the norms that ensure the full right to education. In addition, the understandings and decisions of the Brazilian higher courts, regarding the judicialization of education, will also be used as sources of research. Therefore, it has been proven that the right to education is extremely important for the promotion of people with Down syndrome and for this to happen it is necessary for public power to control educational institutions in Brazil.
