Análise da aplicação da Lei Maria da Penha na cidade de Cajazeiras-PB.

Abstract

In Brazil, the main legal instrument in the fight against domestic violence is the Law 11,340/ 06, popularly known as “Maria da Penha Law”, whose function is to restrain and eliminate all kinds of violence against women. This way, the main objective of this research is to analyze whether the Maria da Penha Law is effectively applied in the city of Cajazeiras-PB, looking forward to know how the fight against domestic and family violence in the city goes on. The investigation becomes relevant due to the significant number of cases of domestic violence in that city, and the in-depth study of the applicability of the Law in the city will identify possible problems regarding its effectiveness. This applicability depends on the mechanisms created by the Law under study to restrain and eliminate all types of violence against women, namely: the application of urgent protective measures, the creation of specialized police stations, reference centers for women , specialized courts, and public policies for women. The methods used were the deductive approach and the historical evolutionary method as a method of procedure, besides bibliographical and documentary research as research techniques, as well as an analysis of the violence data within Cajazeiras in the year 2017 are studied looking for public policies being executed at the city. The current study was carried out at the Delegacia Especializada no Atendimento à Mulher (DEAM), Centro de Referência no atendimento à Mulher (CRAM) and the city Public Policies for Women office(Secretaria Municipal de Políticas Públicas para as Mulheres), which act prevent and eliminate violence in the city in the context of the so called protection network. The work has the following problematic: Are the mechanisms created by the Maria da Penha Law to restrain and eliminate violence against women effectively applied in the city of Cajazeiras-PB? The conclusion reached was that the Maria da Penha Law is effectively applied in the city and that there is a network to deal with domestic and family violence that is active, bringing to everyone the knowledge of the Law and applying the means of protection proposed by it.
