???metadata.dc.description.resumo???: O Poder Legislativo é um dos pilares que sustentam a democracia. Estão a frente deste Poder, os parlamentares, a qual são conferidas imunidades. O estudo pretende observar a sistemática das Imunidades Parlamentares; dissertar acerca do instituto presente no Ordenamento Constitucional Brasileiro, sua origem, finalidade e espécies. O estudo fez uma panorâmica histórica acerca do surgimento dessas prerrogativas. De origem Inglesa, as imunidades parlamentares existem, no Brasil, desde a Constituição Imperialista de 1824. Partindo dessa abordagem, aponta-se a seguinte problematização para a pesquisa: O tom absolutista do preceito proibitivo de prisão cautelar de Deputados e Senadores se coaduna como a essência do sistema constitucional ou servem apenas para privilegiar seus detentores? A título de hipótese, tem-se uma resposta negativa, constatando-se, assim, após se estudar minuciosamente o instituto, com base em julgados, doutrina e no direito comparado, não cabe ao Poder Judiciário criar leis e sim interpretá-las e por essa premissa, nada se faz absoluto na essência. Destarte, registra-se que a presente pesquisa científica tem como objetivo geral analisar a Ação Cautelar que culminou, pela primeira vez na história brasileira, na prisão de um Senador da República em exercício de mandato. Para alcançar este objetivo geral utiliza-se o método dedutivo, como método de abordagem e como método de procedimento o histórico-evolutivo; como técnicas de pesquisa a pesquisa bibliográfica e a pesquisa documental indireta. Diante do estudo, conclui-se que o instituto imunidade parlamentar configura como elemento preponderante ao exercício dos congressistas, e sua presença continua integra e de aplicação obrigatória. Sua não incidência depende de condição especial e excepcional, quando sua aplicação gere afronta a princípios e regramentos constitucionais que se interliguem para garantir a integridade do sistema
Abstract: The legislature is one of the pillars that sustain democracy. They are forward this power, parliamentarians, which immunities conferred. The study aims to observe the systematic Parliamentary Immunities; lecture about this institute in the Brazilian Constitutional Planning, its origin, purpose and species. The study made a historical overview of the emergence of these prerogatives. Of English origin, parliamentary immunities exist in Brazil, from the Imperialist Constitution of 1824. Based on this approach, points to the following questioning for research: The absolutist tone prohibitive precept precautionary arrest of Deputies and Senators sit well as essence of the constitutional system or only serve to privilege holders? As a hypothesis, there is a negative response, having noticed, as well, after thoroughly studying the institute, based on tried, doctrine and comparative law, it is not up to the courts make laws but interpret them and this premise, nothing is absolute in essence. Thus, it is recorded that the present scientific research has as main objective to analyze the Injunction culminating, for the first time in Brazilian history, the arrest of a Senator of the Republic in term of exercise. To accomplish this goal generally is used deductive method, such as method approach and method as the historical-rolling process; as technical research the literature and indirect documentary research. Before the study, it is concluded that the institute parliamentary immunity sets as a major component of the exercise of Congress, and their presence continues integrates and mandatory. Its no incidence depends on special and exceptional condition when your application runs affront to constitutional principles and regramentos who are interconnected to ensure system integrity
