A guarda compartilhada e sua compatibilização com a proteção dos interesses da criança e do adolescente

Abstract

This present paper aims to analyze the shared custodian as the most complete mode to meet all needs of an educational, emotional, psychological and minor identity character, being necessary to be considered the best guard for greater protection and support given to this current subject rights before treated as res and always subjugated to the power of their parents. It is an evolution of the law, based on a transformation of the social mentality to see the underage as the future social being, therefore, the need of extreme care and apparatus that the state and the family can provide, and equality between men and women transforming the social environment and the form of interactions to be lived forward to such plurality of challenges in the raise of children and it is inserted in the labor market. The increasing number of disruption of marital relations made it necessary to search for a new custodian model, to look after the interests of children and parents whom no longer live together.Raising answers to the best model of custodian and the propositions of the Law 13058/14, which is rulling nowadays. It was used the hypothetical deductive methodology which one the questioning took jobs to the documentary and bibliographical survey and found that the law in currency , the joint custody , it has been shown good, with a great effectiveness in the children and adolescents’ protection.
