Tráfico Internacional de mulheres para fins de exploração sexual: uma análise dos instrumentos de proteção.

Abstract

This monograph has as its theme: "International Trafficking in Women for the Purposes of Sexual Exploitation: an Analysis of the Instruments of Protection". The problem that the research seeks to analyze is the application of instruments to protect international trafficking in women, both in Brazil and in the international arena. The hypothesis presented is that despite the ratification of the Palermo Protocol by Brazil, in order to prevent, suppress and punish trafficking in persons, especially women and children, the norm has not been effective in regard to its purpose, since the trafficking is still a constant practice today. The main objective of the research is to discuss the trafficking of women for purposes of sexual exploitation and to analyze the instruments of protection in the national and international context. In turn, it has specific objectives: to identify the performance of groups that practice this modality of crime; analyze the application of protection instruments in the national and international scenario; to present policies to combat trafficking in persons, especially women in Brazil. In relation to the methodology used in the research, we opted for the method of dialectic approach. The procedures used were the case history and the case study. As for the nature of the research, it has an applied nature. Regarding the approach of the problem, the modality used is qualitative. As for the general objectives of the research, it has explanatory character. As for the technical procedure, the research is bibliographical and documentary, with direct and indirect treatment of the sources. As for obtaining data, we opted for content analysis. Structurally, the monograph is divided into four chapters. In the first chapter, an analysis will be made of the historical background of trafficking in women, and of some international arrangements. In the second chapter, a study will be made of the emergence of trafficking in persons in Brazil and the various changes in the National provisions for the protection of women, which is now regulated by Law No. 13344/2016, known as the Trafficking in Persons Act. In the third chapter, it presents the profile of the victim, the profile of the trafficker, how the trafficking routes work, the reasons why the victims accept invitations outside the country of origin, and also analyzes the human rights that are violated by trafficking in people. Finally, in the fourth chapter, policies will be presented to combat trafficking in persons, especially women.
