| ???metadata.dc.description.resumo???: | O presente trabalho monográfico tem como tema a alienação parental e busca fazer uma análise acerca das mais variadas formas de se constituir família no Brasil atual, priorizando sempre o princípio do afeto e o interesse da criança e do adolescente, além de observar a importância do poder familiar no âmbito jurídico. Apresenta-se o instituto da alienação parental, diferenciando-a da síndrome da alienação parental. São expostos os critérios de identificação, as características do genitor alienante e as consequências para as crianças e adolescentes alienados, além de apresentar os principais movimentos que combatem a alienação parental. Discute brevemente a Lei 12.318/2010, Lei da Alienação Parental, mostrando a importância da tipificação da lei, o papel da justiça e as dificuldades em produzir provas convincentes para o caso. Nessa perspectiva, evidenciam-se os aspectos processuais, a maneira como o judiciário deve agir por haver crianças envolvidas. Por fim, se examina a guarda compartilhada como forma de redução da alienação parental, analisando também a responsabilidade civil decorrente dos atos alienatórios, fazendo uma observância ao dano moral decorrente da alienação parental e a Jurisprudência do STJ com relação a casos de alienação parental. |
| Abstract: | The present monographic research work has the theme of parental alienation and seeks to make an analysis about the most varied forms of constituting a family in Brazil today, always prioritizing the principle of affection and the interest of the child and the adolescent, besides observing the importance of family power in the legal sphere. It presents the institute of parental alienation, differentiating it from the syndrome of parental alienation. They expose the identification criteria, the characteristics of the alienating parent and the consequences for the alienated children and adolescents, as well as presenting the main movements that fight against parental alienation. It briefly discusses Law 12.318 / 2010, the Law of Parental Alienation, showing the importance of the law's classification, the role of justice, the difficulties in producing convincing evidence for the case. From this perspective, the procedural aspects are evidenced, the way in which the judiciary must act because there are children involved. Finally, it examines shared custody as a form of reduction of parental alienation, and civil liability arising from alienatory acts, observing the moral damage resulting from parental alienation and the STJ Jurisprudence in relation to cases of parental alienation. |
