Abstract

Parental alienation is a problem that affects the family structure and can cause serious damage to the psychological health of the child or adolescent. It consists of the mental manipulation made to underage seeking deconstruct the emotional bonds between him and his parent. Through disqualification campaigns the conduct of the genitor, implantation of false memories and acts intended to difficult the conviviality and the exercise of parental authority, the underage is mentally programmed to repudiate the alienated parent and approach even more to the alienated. This psychological abuse is practiced, as a rule, the parent who holds the unilateral child custody, taking advantage of the greater approximation generated by the family interaction. In this scenario, the shared custody shows the best solution to preserve the child's welfare. Besides giving permission to live with both parents, facilitates the equal exercise of family power. Whereas preserving the ties of affection, reduces the risk of the underage suffer the parental alienation syndrome, because it hinders the practice of alienating acts. Thus, the research seeks to analyze the shared custody as an effective solution to the problem of parental alienation. Therefore, research is developed through deductive approach, using bibliographic research technique and exegesis-legal. This study is also of considerable legal significance, since it presents an abusive practice that affects family relationships and thus hurts fundamental rights and guarantees of the child.
